February 17, 2025: U.S. President Donald Trump's administration has approached the U.S. Supreme Court regarding the dismissal of Hampton Dellinger, the head of an independent agency that protects government whistleblowers. This marks the first time Trump’s administration has engaged in a legal battle at the Supreme Court over his actions as President.
The Justice Department filed a petition asking the Court to overturn a federal judge's decision on February 12 that temporarily blocked Dellinger’s removal. Dellinger, appointed under President Joe Biden, was supposed to serve a five-year term until 2029. He was informed of his dismissal on February 7 and later filed a lawsuit against the decision.
Dellinger claims that Trump abused his power by attempting to dismiss him, as federal law permits removal only for "inefficiency, neglect of duty, or malfeasance in office." His lawsuit argues, "The Special Counsel’s ability to protect civil service and investigate allegations of misconduct is needed now more than ever."
Dellinger's attorneys argue that such judicial interference is an "unprecedented assault on the separation of powers." By bringing this case to the Supreme Court, the Trump administration aims to take stronger steps in altering the internal structure of the government.
