The arrest of former Philippine President Rodrigo Duterte last month under the International Criminal Court (ICC) custody has created a stir globally and brought to the forefront the potential prosecution of other world leaders by the International Criminal Court (ICC). Duterte, who was criticized for his harsh anti-drug policies, faces charges of crimes against humanity. Although an investigation into Duterte had been ongoing for a long time, his arrest came as a surprise to many experts.

Leila Sadat, a former special adviser to the ICC and professor of international criminal law, said, “This is the first time we’ve seen a situation where an arrest warrant is issued secretly, and the accused person is swiftly arrested. Previously, high-level leaders' warrants were usually issued publicly.”

Duterte's arrest marks a significant moment for the international court, as it may pave the way for future prosecutions of other leaders. However, implementing such arrests is not easy. Leaders like Russian President Vladimir Putin and Israeli Prime Minister Benjamin Netanyahu have also been accused under ICC arrest warrants, but there are many political barriers to enforcing these warrants.

In the context of the Ukraine war, the ICC issued arrest warrants in March 2023 for Putin and Maria Lvova-Belova. However, despite Russia not being a member of the ICC, prosecuting them is challenging. Putin’s strong rule and security apparatus make it nearly impossible to bring him into ICC custody.

Additionally, Netanyahu faces an ICC arrest warrant over alleged crimes against humanity in the ongoing war in Gaza against Hamas. However, Israel is not a member of the ICC and has never recognized ICC arrest warrants.

The ICC has issued arrest warrants against many other world leaders, including former Sudanese ruler Omar al-Bashir. But political pressure against the ICC, a lack of will, and the double standards of global powers often hinder the court's operations.

However, Duterte's arrest may signal a positive change for the ICC, which could play an important role in ensuring the prosecution of top leaders from other countries in the future. Legal experts believe that, one day, it will be possible to prosecute leaders for international crimes, and this will open a new horizon for establishing global justice.
